A woman recently contacted our firm looking for assistance with attorney fees. She was a wife in a long term marriage where the husband provided sole financial support for the family of five. Throughout his military career, the wife remained a stay-at-home-mom to provide for her three children. The husband suggested she incur credit card debt, borrow from family, or use the cash surrender value of her and her minor children’s life insurance policies to pay for the attorney fees.
Outcome
Working alongside attorney Paola Parra Harris, enough evidence was provided to prove that the wife had a “need” (finances for the attorney fees) and the husband had the “ability to pay” for the fees. Due to this, the Court ordered that 100% of the Wife’s fees and costs, including mediation and court reporters, should be paid for by the husband.
