After being together almost eight years, a couple got into a verbal disagreement which ended in both parties contacting law enforcement. The wife made false statements to law enforcement and later filed a Petition for Protection Against Domestic Violence Injunction, alleging that the husband was violent, abused alcohol, and prevented the wife from leaving the home following their argument. Due to these allegations, the wife was granted a temporary Injunction against the husband.
While at trial for the Petition for Protection Against Domestic Violence Injunction the wife introduced various photographs of the husband with his gun collection, which the wife used as “evidence” that the husband was violent and continued to insist he struggled with alcohol abuse. Wife further testified that the husband had threatened to burn their house down and that she was afraid for her life and safety.
Outcome
With the help of Mercedes Blasón-Aguilar of Parra Harris Law, the husband was able to introduce a video recording of the verbal altercation that showed his wife sitting in the husband’s vehicle, refusing to allow him to leave. In the video, the husband appeared calm and the wife did not appear to have any indication of being afraid for her safety. In addition, the husband was also able to prove that the wife had gone to their rental property where he was staying at the time of the trial, thus showing the wife’s lack of fear of her husband.
With this evidence and the legal assistance of Blasón-Aguilar, the husband was successfully able to refute each false allegation made by the wife and as a result, the Court dismissed the wife’s petition for an Injunction. Following the trial, the parties proceeded with a divorce.
