A husband and wife were going through with their divorce, but continued to reside in the same home with their children. The wife contacted Parra Harris Law to assist with her legal matters.

While in the home, the wife was refusing the husband’s advances which resulted in a physical altercation. The husband struck the wife, knocking her to the ground. The wife was fearful of her husband, but did not contact law enforcement. Instead, the wife contacted her attorney at Parra Harris Law, Mercedes Blasón-Aguilar, unaware she could get an Order of Protection against Domestic Violence against her husband.

Outcome

Mercedes of Parra Harris Law provided helpful information to the wife, including that she could obtain an Order of Protection against Domestic Violence against any person, her husband included, if they commit acts of physical violence and cause you to fear for your life and/or safety. The wife sought and was granted a Temporary Injunction for Protection against Domestic Violence with Minor Children against her husband. Prior to the trial on the wife’s temporary injunction, Mercedes and the husband’s attorney, with both parties’ consent, entered into a Consent Order. During this time, the attorneys modified the Temporary Injunction to require the husband to move out of the marital home for a set period of time while the parties proceeded with their divorce proceedings. Both parties agreed to exchange their children at a neutral location to avoid contact.
